Florida is an equitable distribution state, which means that all marital property must be divided equitably, but not necessarily equally, between them. First, all property must be identified as either separate, marital, or commingled. Separate property was acquired prior to the marriage, and this property returns to that spouse. Marital property was acquired during the course of the marriage, and these items are subject to equitable division.
